1. Agreement to Terms

These Terms of Service (“Terms”) are a legally binding agreement between you (“User”, “you”, or “your”) and Yamify Inc. (“Yamify”, “we”, “us”, or “our”), a company incorporated in the United States, headquartered at 5219 Belvedere St, Oakland, CA 94601.

These Terms govern your access to and use of yamify.co and our AI infrastructure platform, including GPU-powered virtual clusters (“YAMs”), deployment services, Model Context Protocol (MCP), and all related tools and features (collectively, the “Services”).

By accessing or using our Services, you confirm that you are at least 16 years of age, have read and understood these Terms, and agree to be bound by them. If you are acting on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Services

Yamify provides an AI infrastructure platform designed for developers, freelancers, startups, and web agencies. Our Services include:

• GPU-powered virtual clusters (“YAMs”) hosted on cloud infrastructure
• One-click deployment of pre-configured AI tools including n8n, LLaMA, AI-powered WordPress, and others
• Model Context Protocol (MCP) for natural language AI tool provisioning
• Local currency billing via mobile money and international payment methods
• AI agent deployment and workflow automation tools
• Developer APIs and third-party integrations

We reserve the right to modify, suspend, or discontinue any part of our Services at any time with reasonable notice.

You agree to use our Services only for lawful purposes and in compliance with these Terms. You must not:

• Use the Services for any illegal purpose or in violation of applicable laws
• Deploy malicious code, malware, viruses, or software designed to cause harm
• Attempt to gain unauthorized access to our systems, other accounts, or third-party infrastructure
• Mine cryptocurrency without our express written consent
• Excessively burden our infrastructure or negatively impact other users’ experience
• Resell or sublicense access to our Services without prior written authorization
• Use the Services to harass, abuse, or harm any person
• Infringe the intellectual property rights of Yamify or any third party
• Use our Services to train AI models for competing commercial products without authorization

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the data practices described in our Privacy Policy.

8. Service Availability

Yamify strives to maintain high availability of our Services but does not guarantee uninterrupted access. We target 99.5% uptime for paid tiers but may experience downtime due to maintenance, upgrades, or circumstances beyond our control. Scheduled maintenance will be communicated in advance where possible.

9. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Yamify does not warrant that the Services will be error-free, secure, or continuously available.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Yamify and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Services. In no event shall Yamify’s total liability exceed the amount you paid to Yamify in the three (3) months preceding the claim.

You agree to indemnify, defend, and hold harmless Yamify and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Alameda County, California, and you consent to personal jurisdiction in such courts.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on this page with a revised effective date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms. If you do not agree, you must stop using the Services.

14. Termination

You may terminate your account at any time by contacting press@yamify.co. We may suspend or terminate your access immediately, without notice, for conduct that violates these Terms or is harmful to other users or third parties.

Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination shall remain in effect, including ownership, disclaimers, indemnity, and limitation of liability.

15. General Provisions

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Yamify regarding the Services.
• Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
• Waiver: Our failure to enforce any right or provision does not constitute a waiver.
• Assignment: You may not assign your rights under these Terms without our prior written consent. Yamify may assign its rights without restriction.
• Force Majeure: Yamify is not liable for delays or failures caused by circumstances beyond our reasonable control.
